By registering as a user, using, viewing, booking, listing, transmitting, caching storing and/or otherwise utilising holiday-malta.com including any subdomains thereof including the services or functions offered hereon and/or the contents and information on this site, you are agreeing to each and all of the terms and conditions of use set forth below without revision or modification, and waive any right to claim ambiguity or error on this User Agreement. It is important to remind periodic or continued users of holiday-malta.com, that these Terms and Conditions and Agreement are subject to amendments, revisions or updating at any time and without prior notice to you, and such periodic or continued users will be conditioned upon the terms and conditions in force at the time of your use. By visiting or booking any service through holiday-malta.com you are accepting any amendments, revisions or updates as and when they may occur. Therefore, you should carefully review the terms and conditions of this Agreement each time you access holiday-malta.com. When these Terms mention “holiday-malta.com,” “we,” “us,” or “our,” it refers to the holiday-malta.com you are contracting with. Should you not agree to each and every term and condition set out herein, you are asked not to use holiday-malta.com and to leave immediately.

1. Who We Are?

holiday-malta.com is operated by Euro Resort Investments Ltd, a company registered in Malta with Company Registration No C28576. Euro Resort Investments Ltd is authorised by the Malta Tourism Authority to act as an Incoming Travel Operator and Destination Management Company under licence no TRA/E33. All the listings featured on this website/platform are owned and managed by independent hosts and suppliers. Euro Resort Investments Ltd solely provides a website/platform through which bookings/reservations of the listings featured on holiday-malta.com may be made.

2. Privacy Policy

We are committed to protecting our visitor's privacy and we will not collect and personal information about you as a visitor unless you provide it voluntarily. 3.1 Contact or Booking Information - When you register as a member/user we need to collect certain personal details from you. Failure to enter the information requested when signing up as a member/user on holiday-malta.com or via subsequent email correspondence will result in not allowing us to process your bookings or listings correctly. Euro Resort Investments Ltd will not be held responsible for any claims if you do not disclose full information when necessary.

Where such websites are operated by third parties, then you will be subject to the Terms & Conditions and Privacy Policy of the website in question. In these cases, Euro Resort Investments Ltd are not responsible for the content of the websites so operated by third parties and will not be responsible for the accuracy of opinions expressed in such websites and such websites are not monitored or checked by us for accuracy or completeness. The inclusion of any linked website on holiday-malta.com does not imply or constitute approval or endorsement of the linked website by us. If you decide to leave holiday-malta.com to access these third party sites, you do so at your own risk.

5. Scope of holiday-malta.com Services

5.1 The holiday-malta.com website/platform is an online marketplace that enables registered users ("Members") and certain third parties who offer services. Members and third parties who offer services are “Hosts” and the services they offer are "Host Services" to publish such Host Services on the holiday-malta.com website/platform (Listings) and to communicate and transact directly with Members that are seeking to book such Host Services. Members using Host Services are “Guests". Host Services may include the offering of hotels, vacation or any other form of holiday accommodation ("Accommodation"), single or multi-day activities in various categories ("Activities"), access to unique events and locations ("Events"), and a variety of other travel and non-travel related services.

5.2 As the provider of the holiday-malta.com website/platform, holiday-malta.com does not own, create, sell, resell, provide, control, manage, offer, deliver, or supply any Listings or Host Services, nor is holiday-malta.com an organiser or retailer of travel packages. Hosts alone are responsible for their Listings and Host Services. When Members make or accept a booking, they are entering into a contract directly with each other. holiday-malta.com is not and does not become a party to or other participant in any contractual relationship between Members, nor is holiday-malta.com a real estate broker or insurer. holiday-malta.com is not acting as an agent in any capacity for any Member. Hosts shall ensure that listed accommodations are at all times equipped with fully functioning fire extinguishers and an information pack with emergency telephone numbers, and other useful information. It shall be the responsibility of the Host to undertake that the accommodation will, at all times, comply in full, with applicable Maltese and EU legislation relating to hygiene, fire, safety and will at all times maintain in force, the appropriate current certificates confirming such compliance.

5.3 The Host shall be responsible for keeping and maintaining the accommodation properly furnished and equipped at all times with, but not limited to, good quality furniture, furnishings, working appliances and domestic equipment, sufficient kitchen utensils, linen and sanitary facilities and services in accordance with the expected standard of the Accommodation in accordance and conformity with Maltese & EU Legislation. The accommodation shall at all times be equipped with the furniture and fittings documented/uploaded on this website , which shall be kept in good working order/condition and up to an adequate standard as required by law. The Host shall also be responsible, prior to accept a booking and with due notice, to inform guests of any disturbances in the vicinity of the property, including but not limited to construction works,which may cause discomfort to the guest during their intended stay at the accommodation.

5.4 The host shall at all times have accommodation covered by any licenses and/or permits that shall be required in terms of Maltese Law. All the relative costs, as well as the responsibility to obtain and maintain in force such licenses and/or permits, shall be at the charge of the Host. Moreover, The Host shall be responsible for ensuring that the terms and conditions of the licence issued in respect of the accommodation concerned are satisfied.

5.5 The Host is agreeing to pay holiday-malta.com an advertising fee equal to the amount of (5) Euro, who herey accepts once the accommodation has been allocated a reference number by holiday-malta.com

5.6 holiday-malta.com shall not be responsible for any injury, illness, death, loss, loss of enjoyment, damage, expense, cost or other sum or claim of any description whatsoever which results from any of the following:

a) The fault of the person(s) affected or any member(s) of their party or,

b) The fault of a third party not connected with the provision of your booking which neither, holiday-malta.com nor the host could have predicted or avoided,

c) ‘Force majeure’ - in these terms and conditions ‘force majeure’ shall mean any event which holiday-malta.com, the host or other supplier(s) of the service(s) in question could not, even with all due care and diligence, foresee or avoid. Such events may include, but are not limited to; adverse weather conditions, water restrictions, war, threat of war, civil strife, industrial action, natural or nuclear disaster, fire, epidemics, terrorism, Acts of God, closure of ports, governmental action and all other events outside our/their control.

d) holiday-malta.com cannot accept responsibility for any services which do not form part of your contract. This includes, for example, any additional services or facilities which the host agrees to provide for you where the services or facilities are not listed on holiday-malta.com.

e) holiday-malta.com, hosts and other service providers cannot accept liability or pay any compensation where the performance or prompt performance of your respective contractual obligations is prevented or affected by, or you otherwise suffer any damage or loss as a result of ‘force majeure’.

5.7 holiday-malta.com has no control over and does not guarantee (i) the quality, safety or suitability of any Listings or Host Services, (ii) the truth or accuracy of any Listing descriptions, Ratings, Reviews, or other Member Content (as defined below), or (iii) the performance or conduct of any Member or third party. holiday-malta.com does not endorse any Member, Listing or Host Services. Any references to a Member being "verified" (or similar language) only indicate that the Member has completed a relevant verification or identification process and nothing else. Any such description is not an endorsement, certification or guarantee by holiday-malta.com about any Member, including of the Member's identity or background or whether the Member is trustworthy, safe or suitable. You should always exercise due diligence and care when deciding whether to stay in an Accommodation, participate in an Activity or Event or use other Host Services, accept a booking request from a Guest, or communicate and interact with other Members, whether online or in person. Verified Images (as defined below) are intended only to indicate a photographic representation of a Listing at the time the photograph was taken, and are therefore not an endorsement by holiday-malta.com of any Host or Listing.

5.8 If you choose to use the holiday-malta.com website/platform as a Host (as defined below), your relationship with holiday-malta.com is limited to being an independent, third-party contractor, and not an employee, agent, joint venturer or partner of holiday-malta.com for any reason, and you act exclusively on your own behalf and for your own benefit, and not on behalf, or for the benefit, of holiday-malta.com. holiday-malta.com does not, and shall not be deemed to, direct or control you generally or in your performance under these Terms specifically, including in connection with your provision of the Host Services. You acknowledge and agree that you have complete discretion whether to list Host Services or otherwise engage in other business or employment activities.

5.9 To promote the holiday-malta.com website/platform and to increase the exposure of Listings to potential Guests, Listings and other Member Content may be displayed on other website/website/platforms, in applications, within emails, and in online and offline advertisements. To assist Members who speak different languages, Listings and other Member Content may be translated, in whole or in part, into other languages. holiday-malta.com cannot guarantee the accuracy or quality of such translations and Members are responsible for reviewing and verifying the accuracy of such translations. The holiday-malta.com website/platform may contain translations powered by Google. Google disclaims all warranties related to the translations, express or implied, including any warranties of accuracy, reliability, and any implied warranties for merchantability, fitness for a particular purpose and non-infringement.

5.10 The holiday-malta.com website/platform may contain links to third-party website/website/platforms or resources (“Third-Party Services”). Such Third-Party Services may be subject to different terms and conditions and privacy practices. holiday-malta.com is not responsible or liable for the availability or accuracy of such Third-Party Services, or the content, products, or services available from such Third-Party Services. Links to such Third-Party Services are not an endorsement by holiday-malta.com of such Third-Party Services.

6. Eligibility, Using the holiday-malta.com website/platform, Member Verification

6.1 You must be at least 18 years old and able to enter into legally binding contracts to access and use the holiday-malta.com website/platform or register an holiday-malta.com Account. By accessing or using the holiday-malta.com website/platform you represent and warrant that you are 18 or older and have the legal capacity and authority to enter into a contract.

6.2 holiday-malta.com may make access to and use of the holiday-malta.com website/platform, or certain areas or features of the holiday-malta.com website/platform, subject to certain conditions or requirements, such as completing a verification process, meeting specific quality or eligibility criteria, meeting Ratings or Reviews thresholds, or a Member’s booking and cancellation history.

6.3 User verification on the Internet is difficult and we do not assume any responsibility for the confirmation of any Member’s identity.

6.4 The access to or use of certain areas and features of the holiday-malta.com website/platform may be subject to additional seperate policies, house rules, standards or guidelines, or may require that you accept additional terms and conditions.

6.5 By registering as a user/member the holiday-malta.com website/platform you are responsible to keep your password secret. This means you must not disclose it to anyone else or record it in any way, which allows another person to discover it.

7. Account Registration

7.1 You must register an account ("holiday-malta.com Account") to access and use certain features of the holiday-malta.com website/platform, such as publishing or booking a Listing. If you are registering an holiday-malta.com Account for a company or other legal entity, you represent and warrant that you have the authority to legally bind that entity and grant us all permissions and licenses provided in these Terms.

7.2 You can register an holiday-malta.com Account using an email address and creating a password.

7.3 You must provide accurate, current and complete information during the registration process and keep your holiday-malta.com Account and public holiday-malta.com Account profile page information up-to-date at all times.

7.4 You may not register more than one (1) holiday-malta.com Account unless holiday-malta.com authorizes you to do so. You may not assign or otherwise transfer your holiday-malta.com Account to another party.

7.5 You are responsible for maintaining the confidentiality and security of your holiday-malta.com Account credentials and may not disclose your credentials to any third party. You must immediately notify holiday-malta.com if you know or have any reason to suspect that your credentials have been lost, stolen, misappropriated, or otherwise compromised or in case of any actual or suspected unauthorized use of your holiday-malta.com Account. You are liable for any and all activities conducted through your holiday-malta.com Account, unless such activities are not authorized by you and you are not otherwise negligent (such as failing to report the unauthorized use or loss of your credentials).

8. Content

8.1 holiday-malta.com may, at its sole discretion, enable Members to (i) create, upload, post, send, receive and store content, such as text, photos, audio, video, or other materials and information on or through the holiday-malta.com website/platform ("Member Content"); and (ii) access and view Member Content and any content that holiday-malta.com itself makes available on or through the holiday-malta.com website/platform, including proprietary holiday-malta.com content and any content licensed or authorized for use by or through holiday-malta.com from a third party ("holiday-malta.com Content" and together with Member Content, "Collective Content").

8.2 Subject to your compliance with these Terms, holiday-malta.com grants you a limited, non-exclusive, non-sublicensable, revocable, non-transferable license to (i) download and use the Application on your personal device(s); and (ii) access and view any Collective Content made available on or through the holiday-malta.com website/platform and accessible to you, solely for your personal and non-commercial use.

9. Service Fees

9.1 holiday-malta.com may charge fees to Hosts ("Host Fees") and/or Guests ("Guest Fees") (collectively, "Service Fees") in consideration for the use of the holiday-malta.com website/platform.

9.2 Any applicable Service Fees (including any applicable Taxes) will be displayed to a Host or Guest prior to publishing or booking a Listing. holiday-malta.com reserves the right to change the Service Fees at any time, and will provide Members adequate notice of any fee changes before they become effective.

9.3 You are responsible for paying any Service Fees that you owe to holiday-malta.com. The applicable Service Fees (including any applicable Taxes) are collected by holiday-malta.com Payments. holiday-malta.com Payments will deduct any Host Fees from the Listing Fee before remitting the payout to the Host. Any Guest Fees are included in the Total Fees collected by holiday-malta.com.

10. Booking a listing/accommodation

10.1 You understand that a confirmed booking of an Accommodation (“Accommodation Booking”) is a limited license granted to you by the Host to enter, occupy and use the Accommodation for the duration of your stay, during which time the Host (only where and to the extent permitted by applicable law) retains the right to re-enter the Accommodation, in accordance with your agreement with the Host.

10.2 You agree to leave the Accommodation no later than the checkout time that the Host specifies in the Listing or such other time as mutually agreed upon between you and the Host. If you stay past the agreed upon checkout time without the Host's consent (“Overstay”), you no longer have a license to stay in the Accommodation and the Host is entitled to make you leave in a manner consistent with applicable law. In addition, you agree to pay, if requested by the Host, for each twenty-four (24) hour period (or any portion thereof) that you Overstay, an additional nightly fee of up to two (2) times the average nightly Listing Fee originally paid by you to cover the inconvenience suffered by the Host, plus all applicable Guest Fees, Taxes, and any legal expenses incurred by the Host to make you leave (collectively, "Overstay Fees"). Overstay Fees for late checkouts on the checkout date that do not impact upcoming bookings may be limited to the additional costs incurred by the Host as a result of such Overstay. If you Overstay at an Accommodation, you authorize the host to charge you Overstay Fees.

10.3 If a Security Deposit is required by a Host, this is to be paid directly to the host on arrival/check in to the accommodation.

10.4 Certain accommodations may offer “pay per use” services which may include, but are not limited to; Telephone, Air Conditioning, Internet, Electricity & Water Consumption. This is usually detailed on the relevant listing page on holiday-malta.com, however we recommend that you ask hosts about any applicable "pay per use” services in the accommodation prior to making a booking.

11. Booking Activities, Events and other Service displayed on holiday-malta.com

11.1 You should carefully review the description of any Activity, Event or other Host Service you intend to book to ensure you (and any additional guests you are booking for) meet any minimum age, proficiency, fitness or other requirements which the Host has specified in their Listing. At your sole discretion you may want to inform the Host of any medical or physical conditions, or other circumstances that may impact your and any additional guest’s ability to participate in any Activity, Event or other Host Service. In addition, certain laws, like the minimum legal drinking age in the location of the Activity, Event or other Host Service, may also apply. You are responsible for identifying, understanding, and complying with all laws, rules and regulations that apply to your participation in an Activity, Event or other Service.

11.2 Before and during an Activity, Event or other Host Service you must at all times adhere to the Hosts or service providors instructions.

11.3 You may not bring any additional individuals to an Activity, Event or other Host Service unless such an individual was added by you as an additional guest during the booking process on the holiday-malta.com website/platform.

12. Booking Modifications, Cancellations and Refunds

12.1 Hosts and Guests are responsible for any modifications to a booking that they make via the holiday-malta.com website/platform or direct holiday-malta.com customer service to make ("Booking Modifications"), and agree to pay any additional Listing Fees, Host Fees or Guest Fees and/or Taxes associated with such Booking Modifications.

12.2 Guests can cancel a confirmed booking at any time pursuant to the Listing’s cancellation policy, and holiday-malta.com Payments will refund the amount of the Total Fees due to the Guest in accordance with such cancellation policy. Unless extenuating circumstances exist, any portion of the Total Fees due to the Host under the applicable cancellation policy will be remitted to the Host by holiday-malta.com pursuant to the Payments Terms.

12.3 For Activities, Events and other Host Services, if inclement weather creates an unsafe or uncomfortable scenario for Guests, Hosts may modify or cancel a Host Service. If there is a substantial change in the itinerary or the Host Service needs to be cancelled, holiday-malta.com will work with the Host and/or Guests to provide Guests an alternative date for the Host Service, an appropriate refund or a rebooking.

12.4 In certain circumstances, holiday-malta.com may decide, in its sole discretion, that it is necessary to cancel a confirmed booking and make appropriate refund and payout decisions. This may be for reasons set forth in holiday-malta.com's Extenuating Circumstances Policy or (i) where holiday-malta.com believes in good faith, while taking the legitimate interests of both parties into account, this is necessary to avoid significant harm to holiday-malta.com, other Members, third parties or property, or (ii) for any of the reasons set out in these Terms.

13. Ratings and Reviews

13.1 Within a certain time frame after completing a booking, Guests and Hosts can leave a public review (“Review”) and submit a star rating (“Rating”) about each other. Ratings or Reviews reflect the opinions of individual Members and do not reflect the opinion of holiday-malta.com.

13.2 Members are prohibited from manipulating the Ratings and Reviews system in any manner, such as instructing a third party to write a positive or negative Review about another Member.

13.3 Ratings and Reviews are part of a Member’s public profile and may also be surfaced elsewhere on the holiday-malta.com website/platform (such as the Listing page) together with any other information at the sole discretion of the operators of holiday-malta.com

14. Damage to Accommodations, Security Deposits and Insurance

14.1 As a Guest, you are responsible for leaving the Accommodation (including any personal or other property located at the Accommodation) in the condition it was in when you arrived. You are responsible for your own acts and omissions and are also responsible for the acts and omissions of any individuals whom you invite to, or otherwise provide access to.

14.2 If you or any member of your party breach any terms and conditions contained herein, or behave in such a way as to, breach any local laws, cause or be likely to cause danger, upset or distress to any third party or damage to the acccomodation, the hots or holiday-malta.com on behalf of the host are entitled, without prior notice, to terminate your booking at the accommodation prior to its expiry and bill you with any costs. In this situation, you or the responsible person(s) in your party will be required to leave the accommodation. holiday-malta.com will have no further responsibility toward such person(s) including any alternative accommodation arrangements. No refunds will be made and holiday-malta.com will not pay any expenses or costs incurred as a result of the termination.

14.3 On departure from an accommodation guests are expected to remove all their personal items including all foodstuffs, empty fridges/freezers, empty all bins, empty dishwasher and filter, flush toilets, wash up and put away all used kitchen equipment, return all items to their original positions, wipe surfaces, sweep floors and dispose of all household rubbish at the designated disposal point. The host or any other contact person appointed by the host may conduct an inspection of the accommodation in your presence. If you do not allow this and any damage, breakages, losses, etc that are found after your departure, it will be presumed that these have been caused by you and you will be required to pay for any such damage, breakages, losses etc.

14.4 Certain accommodation listings may be subject to a refundable security deposit and/or a breakage deposit, which is to be paid directly by the guest to the host on arrival. For avoidance of doubt refundable security deposits and/or a breakage deposits are seperate from the total accommodation rental fees paid on holiday-malta.com.

14.5 If a guest has not caused any damage and/or breakages at an accommodation, the security deposit will be returned by the Host prior to departure from the accommodation.

14.6 When you book an accommodation through holiday-malta.com, you accept responsibility for any fine, damage or loss caused by you or any member of your party. Full payment for any such fine, damage or loss must be paid direct at the time to the Host or any other contact person appointed by the Host. If you fail to do so, you will be responsible for meeting any claims subsequently made against holiday-malta.com together with any legal costs as a result of your actions.

14.7 Upon your arrival at an accommodation it is your responsibility to check the accommodation and its contents in the presence of the host or any other contact person appointed by the host. If at this time you discover that anything is missing or damaged then this must be reported IMMEDIATELY to the host or any other contact person appointed by the host otherwise it may be presumed that the damage/loss was caused by you. In the event of damages, breakages, losses, additional cleaning due to an accomodatio property left excessively dirty or other costs including supplements for any additional guests not previously booked, you agree to pay any additional charges to the host or any other contact person appointed by the host on site. If you fail to do so the host or holiday-malta.com on behalf of the host reserve the right to pursue you for any such costs and a charge may be made to Your credit/debit card for the value of repair or replacement or, where you may have been requested to provide a refundable security deposit and/or breakage deposit, the value of the repair or replacement shall be deducted accordingly. You reserve the right to ask for a receipt of such charges including a copy of the invoice for the replaced or repaired items directly from the host.

14.8 You are recommended to take out adequate insurance cover before travelling to Malta. It is your responsibility to ensure that the insurance cover that you purchase is adequate for your particular needs and you should be covered for force majeure, cancellation expenses, accidental damage to the accommodation, activity or any other service you booked through holiday-malta.com as well as personal liability for yourself and for all tavellers in your party.

14.9 holiday-malta.com will not be held responsible for any claims arising during your holiday in the Maltese Islands.

15. Complaints Procedure

In the event that you have a complaint on anything concerning the accommodation you have booked, you are to bring this to the attention of the Host immediately in order to ensure that your complaint is remedied and may be solved as soon as possible. If within 24 hours after alerting the Host your complaint is still not seen to, you are to escalate this complaint immediately by cntacting holiday-malta.com customer support using the messages tab in your account between Monday to Friday from 0900hrs to 1700hrs (CET) Except Public Holidays. All complaints must be lodged during your stay at the relevant accommodation you have booked in order to ensure that such complaints can be remedied and settled immediately. holiday-malta.com will not entertain and will not be held responsible for any complaints and claims made by you after you have left or checked-out of the accomodation

16. Severability 

If any provision of this Agreement is held to be invalid or void for any purpose, it shall for that purpose be deemed to be omitted from this Agreement. Such omission shall not affect or prejudice the validity, effectiveness or enforceability of the rest of the provisions of this Agreement. 

17. Applicable Law & Jurisdiction

This is a Maltese Website and is subject to the Laws of the Republic Of Malta, and all disputes are subject to the exclusive jurisdiction of the Courts of Justice Of Malta.
